Terms and Conditions of Members of the All-new Loyalty Programme:
Members of the New Yaohan "All-new Loyalty Programme" is exclusively for the customers of all operating retail stores of Panda Sociedade de Gestão de Investimentos Limitada (hereinafter referred to as "New Yaohan") and is governed by the following Terms and Conditions:
I. Membership Registration
1. You must first install the application, create a member account, and register as a member of the All-new Loyalty Programme (hereinafter referred to as "Member") to calculate the amount spent and accumulate points.
2. Membership applicants must be at least 18 years old, (i) Install the “New Yaohan” application on their mobile device or use the WeChat mini program “New Yaohan Member Center” (hereinafter referred to as “Application”); (ii) Read the Terms and Conditions and the New Yaohan’s “Privacy Statement” quoted therein; (iii) Provide necessary items on the membership registration form and click that you have read and agree to the Terms and Conditions. When registering as a member, you need to provide information such as name, gender, birth month, mobile phone number, email address, residential area, and password to receive all eligible rewards; (iv) After registration, you need to verify your mobile phone number by receiving an SMS verification code. This application will use the registered mobile phone number for identity recognition, and each mobile phone number can only be registered as a member once.
3. If there are any changes to the mobile phone number and/or birth month registered in the member account, the member must go to the New Yaohan Member Service Center to apply for changes in person. We reserve the right to require members to provide identification to verify and process requests for changes in information.
4. The purposes of collecting members' personal data are the following: (i) handling your account application and maintaining and managing your account; (ii) identifying you and any accounts you hold with New Yaohan; (iii) enabling the provision of products or services to you; (iv) conducting identity verification; (v) verifying your eligibility to our offers of products, services, promotions or other events; (vi) processing of payment instructions; (vii) order processing, billing and fulfilment; (viii) direct marketing of the products and services as set out in paragraph 8 below; (ix) designing services for you; (x) conducting research, statistical analysis and behavioral analysis; (xi) customer profiling and analysing your purchasing preferences; (xii) making suggestions and recommendations to you and other users of New Yaohan’s services of goods and services that may interest you or them; (xiii) customising this site and its content to your particular preferences; (xiv) providing customer services; (xv) handling your complaints and account enquiries; (xvi) fraud prevention and detection; (xvii) complying with applicable laws, rules and regulations; and (xviii) any other purposes directly related to the purposes for which the Personal Data were originally collected.
5. For information on how New Yaohan uses your personal data, please refer to New Yaohan’s “Privacy Statement”. In the event of any conflict between the terms of this Privacy Statement and the Terms and Conditions, the Terms and Conditions shall prevail.
6. You must agree, guarantee, and declare that the information provided when registering as a member is true, correct, and complete. The personal information you provide to New Yaohan will be kept and used by New Yaohan to provide you with product promotion and related customer services. Our company will not disclose your personal data to third parties.
7. If there are any inaccuracies or changes to the information you submitted to New Yaohan when registering as a member, you agree to update immediately in your personal profile or apply to New Yaohan for updates. Within the scope permitted by law, New Yaohan will not bear any liability for any claims, requests, liabilities, or lawsuits caused by your omission, negligence, and/or failure to provide the latest information, the accuracy and completeness of such information.
8. When you register as a member using the application, you can choose to join or opt out of receiving promotional emails and SMS (SMS / MMS) from New Yaohan. Afterwards, users can also choose to join or opt out of receiving emails and text messages at any time through the personal profile settings in their account in the application. Similarly, you can also choose to join or opt out of receiving push notifications from New Yaohan to your device and in the application. This may include promotional information, offers, and system messages sent to the user’s device and in the application. Users can choose to stop receiving push notifications at any time through the “Settings” function of their device. Opting out of push notifications will not affect the user’s settings for receiving emails and text messages.
9. New Yaohan will not retain members' personal data for longer than is permitted by applicable Macau laws.
10. When transmitting information over the Internet, there is a risk that it may be read and used by third parties who are not licensed or authorized to do so. If you are concerned about such risks, please contact New Yaohan using a means other than the Internet or visit the New Yaohan Member Service Center in person to provide the information required to register for a member's account.
11. The member account is held by you, and the member account cannot be sold, transferred, assigned, or shared with family, friends, or others. If you encounter any errors when logging in or using the member account, please call the customer service hotline.
II. Member Consumption Points
12. Members can accumulate 1 “NY point” (hereinafter referred to as “Points”) for every 1 Macau dollar spent on actual purchase(s). Points have no cash value and cannot be exchanged for cash in any way, see paragraphs 18 to 22 for information on how points are used.
13. If members want to earn points, you must provide your application’s member QR code or member number before completing the transaction. The points will be automatically deposited into your member account within 48 hours after you complete the shopping and displayed in the application. Points earned in designated promotional activities may take longer, please refer to the terms and conditions of the relevant promotional activities.
14. Except the situations specifically provided for in paragraph 21 of the present Terms and Conditions, the consumption points will not be reissued after the transaction is completed.
15. The validity period of member points is from the quarter when the points are earned for the last day of the same quarter of the following year (example of points validity period: the points earned on January 1, 2024, are valid until 23:59:59 on March 31, 2025). The validity period of the member level is calculated from the first activation date of the member to the day before the same date of the following year, the member level is determined by the accumulated consumption amount of the member during the validity period (example of membership level validity period: if you upgrade on January 15, 2024, the membership level expiration date is 23:59:59 on January 14, 2025). If the accumulated consumption reaches the specified membership level amount, your membership will be automatically upgraded with immediate effect. In addition, when your membership level expires, the system will determine whether to maintain or adjust your membership level on the following day and update the validity period of your membership level. Member benefits, rebates, and services are for members’ own use, members should not provide their member accounts for use by others. New Yaohan does not provide monthly transaction statements to members.
16. New Yaohan reserves the right to change the benefits of each membership tier and its related terms and conditions at any time. Any changes, updates or modifications will be effective immediately upon posting on this website. New Yaohan recommends members to check the Terms and Conditions on this website regularly.
17. If you return an item to New Yaohan for a refund, the relevant points earned must be deducted from your member's account. If the points have been redeemed so that the balance of the refunded points is less than the number of points to be deducted, you will be required to return the redeemed reward or reimburse a fee of the same value as the reward. You agree that New Yaohan will retain the amount of the refund until the relevant refund or reimbursement has been made to ensure that the relevant refund or reimbursement has been made.
18. If you are suspected of earning points through fraud, dishonest means, or not in accordance with these terms, we reserve the right to deduct points from your member account and all rights to pursue.
III. Use of Points
19. You are only entitled to use the points in your member's account to redeem cash coupons, products, services, discounts, gifts or redemption coupons (hereinafter referred to as "Rewards")
20. The redemption of any reward, including the use, delivery or collection of any reward, will be subject to additional terms and conditions which will be posted on our website and/or the Application. You will be required to read and click to agree to the terms and conditions before redeeming your rewards.
21. If members want to earn points, you must provide the member's QR code or member's number of your application before completing the transaction. Points will not be reissued after the completion of the transaction unless there is a technical problem with the system, or the member has a valid and reasonable excuse and provides proof of such.
22. The number of reward points required to redeem each reward will be specified by New Yaohan from time to time. You can check the number of points required for each reward through our application. The points required for redemption will be deducted from the member's account immediately.
23. Without prejudice to the application of paragraph 17 above, once redeemed, points cannot be refunded or exchanged for rewards; rewards cannot be exchanged for cash.
IV. Others
24. If you lose your mobile phone installed with the application or the mobile phone is stolen, or if you have reason to believe that your member account has been used by others or the account password has been disclosed to unauthorized persons, you should provide your registered phone number and email address and notify New Yaohan to request an immediate suspension of your member account.
25. You have the responsibility to properly keep your member account and password and ensure the security of your member account and password. For any loss or damage directly or indirectly caused and/or related to the loss of the mobile phone with the member account installed or the theft of the mobile phone and/or the improper use of your member account or the disclosure of the account password to unauthorized persons, New Yaohan is not responsible.
26. New Yaohan reserves the right not to compensate for any loss of points or damage caused by technical problems or errors that prevent us from retrieving information about your points balance from our computer system.
27. New Yaohan reserves the right to suspend, revise or terminate the Terms and Conditions related to this membership at any time. In case of any dispute, New Yaohan reserves the final decision. These terms are provided in Chinese and English versions. In case of any discrepancy, the Chinese version shall prevail.
28. The Terms and Conditions shall be governed by and construed in accordance with the laws of the Macao Special Administrative Region, and in the event that disputes arising out of the Terms and Conditions cannot be resolved by agreement, they shall be referred to the courts of the Macao Special Administrative Region.
